Welcome to CosyBeauty online store. To ensure your rights, as well as to make you feel confident and secured using CosyBeauty store, please carefully read the following CosyBeauty terms of use (Regulations), which are considered to be a contract between the Ltd. "Vitrina " and you.
1. General information
1.1. This document is a contract between the Ltd. "Vitrina" (Admin) and you (Customer) for the use of e-commerce web site CosyBeauty (hereinafter - Shop). Client, registering in the shop, or using each service in a CosyBeauty.com shop (hereinafter - services), undertakes all the obligations laid down in these Rules.
1.2. The administrator has the right at any time to change these rules, taking into account the existing legislation of the Republic of Lithuania. Rules changes take into effect after their publication in the shop. If the customer uses any service of the shop after rules changes publication in the shop, it means that customer agrees with the changed terms of use. Contrary, customer loses the right to use shop services .
2. Login.
2.1. Customer unconditionally agrees and confirms that he, and not the administrator, is responsible for any personal and login information and other data, including user name, password, residence address, phone number, email address which are necessary for the client to login to the shop or use any other service (hereinafter - login), secrecy.
2.2. Customer undertakes commitment to provide only correct and complete information about himself
2.3. Customer undertakes commitment to change any personal information in the shop if it becomes old or false.The Parties agree that the Administrator will perform all his duties and its rights in accordance with the presumption that the client's provided login data is correct and complete. Administrator in any case will not be liable for damages made to Client and (or) third parties if the Customer provided incorrect and (or) incomplete data.
2.4. The Parties agree that the administrator has the right at any time, unilaterally, in its sole discretion and without informing the Customer to change or delete all or part of the client's login or personal information, as well as other information which the Customer in any manner provide the administrator. Administrator has the right to change it, to restrict or prohibit access Customer's use of all or part of the services on the store.
3. General provisions.
3.1. When using the store services customer must respect and don't prejudice established norms of behavior and morality,don't intact law regulations and third party rights and legitimate interests, including intellectual property, personal data protection, advertising regulation, and others.
3.2. Customer acknowledges that he is adult or he received his parents, guardians or supervisors permission to use the shop. Person, who gave the permission to other to use the shop for any minor, the person and (or) Customer acknowledges that he is responsible for all the terms of this Agreement.
4. Purchase/sale contract.
4.1. Customer orders the goods by providing the administrator the order using a e-shop system for placing orders. Purchase sales contract is considered concluded from the moment the client pays for the individual order, and this is reflected in the Administrators bank / paypal or other payment instrument account.
5. Goods and their prices.
5.1. The goods of this contract is the meaning of all items, which the administrator provides at the time of order approval, and which is published in the shop.
5.2. The administrator reserves the right at any time, without having to inform the client, to change any information and other conditions about goods which are in the shop.
5.3. Individual good price is shown near the product's description.
6. Payment
6.1. The administrator starts to fulfill the order only after the customer pays for the goods and their delivery. Pursuant must pay the price for the goods and the delivery cost according the instructions for payment, but not later than 48 hours after the purchase-sale agreement is made. Payment is considered made when the total amount of money is received and offset at the Administrator's bank account
6.2. If the customer don't pay for the goods within 48 hours, the order is cancelled.
7. Delivery of goods
7.1. Administrator delivers or sends the goods to clients provided address.
7.2. Delivery of goods in the Republic of Lithuania price is stated in the shop's electronic orders system at the moment the good is put to shopping cart. Approximately shipping price is stated in the CosyBeauty website in the "delivery" article. Exact shipping price of all purchase is shown at the moment all goods are put to shopping cart.
7.3. In the Republic of Lithuania goods are delivered to the client within 2 - 5 working days after payment receipt.
7.4. The administrator is not responsible for the delivery delay if it happens for third-party carrier company guilt.
7.5. The customer's ordered goods are shipped by mail services or transmitted by an authorized representative of the Administrator and the order is delivered to Customer's provided address. If the ordered goods will be taken by different person (not who ordered the goods), client must write that person's personal details - name and surname.
7.6. Customer agrees that at the moment goods are delivered to customers provided address and when customer signs invoice it means that goods are fully delivered to the Customer.
7.7. If the customer refuses to accept the ordered goods, or goods to the client can not be delivered because the customer provided wrong goods delivery address Customer will be responsible for all expenses which Administration will have because of Customer's guilt. Returned goods will not be re-sent to the customer.
7.9. If the Customer fails in any of its obligations and responsability under these Rules, the administrator has the right not to deliver the ordered goods, and without recourse to the court to terminate the purchase agreement. About the termination of purchase agreement Customer is informed by the e-mail which he provided in his personal details/login information. In this way, the money payed for the goods will not be returned.
8. Right to recall
8.1.Customer can return goods which are in the same condition they were received and which return possibility is listed in a Republic of Lithuania laws. These goods Customer can return by the carrier or mail services not later than 14 days after Customer received these goods. In this way client will get back all money which he payed for these goods. Goods shipping/delivery expenses are not refundable. Expenses related to goods return (shipping/delivery) to Administrator is fully covered by Customer.
8.2. Returned goods must be fully equipped and can not be used. Goods must be returned in the packaging in which they were presented. For complete product and the packing assembly is responsible customer. Returned goods must be not damaged. If the item is not fully completed, is corrupt, inefficient and / or properly packaged, Administrator shall have the right not to accept returned goods, and not to return the money paid by customer for these goods.
8.3. For goods that are returned in accordance with the rules of Article 9 the money to the Client is returned not later than 30 days after delivery of the returned goods back to the administrator.
8.4. Customer can not return the goods which return possibility is not listed in a Republic of Lithuania laws.
9. Intellectual property.
9.1. All rights to the store and its works are reserved. Any shop content or information may not be copied, made available or distributed without the prior written consent of the Administrator.
9.2. All trademarks, which are in the shop are the property of the Administrator or the Administrator has the right to use them.
10. Administrator's limited responsibility
10.1. Customer agrees that the administrator will not be responsible for the shops and (or) technical services failure and also is not responsible for the client or third party loss or damage because of technical shop's failures.
10.2. Administrator responsibility to Customer or any third person is limited in the amount of money the customer paid for the last product purchased from the Administrator.
11. Final terms policies
11.1 All of the client and the Administrator disagreements are solved in the way of negotiation. If the parties don't find proper option, disagreements are solved according to Republic of Lithuania laws.
